Two federal statutes shape every military divorce alongside California law. Understanding how they interact with California’s community property rules is essential before filing.

The Uniformed Services Former Spouses’ Protection Act (USFSPA)

The USFSPA is the federal law that authorizes states to divide military retirement pay as marital property. Under USFSPA and California’s community property rules, the portion of a service member’s retirement pay earned during the marriage is generally subject to equal division.

The Defense Finance and Accounting Service (DFAS) can pay a former spouse directly only when the marriage and military service each lasted at least 10 years and overlapped by at least 10 years, known as the 10/10 rule. Courts may still award a share of retired pay when that threshold isn’t met, but the former spouse would collect through the service member rather than directly from DFAS.

The Servicemembers Civil Relief Act (SCRA)

The SCRA allows an active-duty service member to request a stay of divorce proceedings for at least 90 days when military duties prevent participation. A service member may also waive the stay if both parties want to proceed without delay.

California Residency & Jurisdiction Rules

One spouse must have lived in California for at least six months and in the filing county for at least three months before filing for divorce. Military personnel may have options about where to file depending on domicile, duty station, and the non-military spouse’s residence. Service of process on a deployed spouse follows specific rules depending on whether they are stationed domestically or overseas.

TRICARE Eligibility After Divorce

Under the 20/20/20 rule, a former spouse may retain TRICARE health coverage if the marriage lasted at least 20 years, the service member completed at least 20 years of creditable service, and those two periods overlapped by at least 20 years. If the overlap was at least 15 but fewer than 20 years, the 20/20/15 rule may provide up to one year of TRICARE coverage after the divorce is finalized.

Former spouses who don’t qualify under either rule lose TRICARE when the divorce is final and may need to arrange alternative coverage such as COBRA.

Access to commissary, exchange, and base privileges generally ends at divorce for spouses who don’t meet the 20/20/20 threshold. Base housing timelines and any available extensions vary by installation.

Dividing Military Retirement Pay: COAP, Marital Share, & the Survivor Benefit Plan

Dividing military retired pay requires a court order that DFAS will accept. Unlike the Qualified Domestic Relations Order (QDRO) used to divide civilian retirement accounts, the correct document for military retirement is called a Court Order Acceptable for Processing (COAP), and it must be drafted to meet DFAS’s specific requirements.

Calculating the Marital Share

Only the share of military retired pay earned during the marriage qualifies as community property under California law. The marital share is typically calculated by comparing the years of military service earned during the marriage to the service member’s total years of creditable service at retirement. Service completed before the marriage or after the date of separation is generally treated as separate property.

Disability Pay & the Survivor Benefit Plan

Two related issues can affect how much a former spouse actually receives. Disability pay and Combat-Related Special Compensation (CRSC) are generally not divisible as community property under federal law, which can reduce the retirement benefit available for division. The Survivor Benefit Plan (SBP) is a separate but connected decision: it provides a monthly annuity to a named beneficiary after the service member’s death, and how SBP coverage is handled must be addressed in the divorce agreement.

Serving Divorce Papers on a Deployed Spouse

California law requires that divorce papers be served directly on the respondent regardless of where they are stationed.

Domestic & Overseas Service of Process

For a service member stationed domestically, service may be completed in person or by mail with a Notice and Acknowledgment of Receipt. For a spouse stationed overseas, service may be made by certified mail with return receipt to an Army Post Office (APO) or Fleet Post Office (FPO) address, though some overseas locations may require additional coordination.

Once served, an active-duty service member who can’t appear in court due to military duties may request an SCRA stay of at least 90 days. Courts may grant longer stays depending on circumstances. A service member may also waive the stay, which is sometimes appropriate when both parties want to resolve the matter without delay.

Summary Dissolution for Straightforward Cases

Some uncontested military divorces qualify for California’s summary dissolution process, which applies when the marriage was five years or less, the couple has no children, assets and debts are minimal, and neither party requests spousal support. A deployed spouse can sign and return the joint petition by mail, making summary dissolution a practical option in straightforward cases.
