California Law on Grandparent Visitation

California Family Code §3104 governs grandparent visitation petitions and sets a two-part test. A grandparent must show, first, that a pre-existing bond exists between the grandparent and grandchild, one meaningful enough that continued contact serves the child’s interests. Second, the court balances the child’s interest in that visitation against the parents’ right to exercise their parental authority.

That second requirement reflects the constitutional backdrop established by the U.S. Supreme Court in Troxel v. Granville (2000), which affirmed that parents have a fundamental right to direct the upbringing of their children and that their decisions deserve significant deference. California courts take this seriously when weighing grandparent visitation petitions.

When Grandparents Can Petition for Visitation

As a general rule, grandparents can’t file a visitation petition if the child’s parents are married and living together. California law recognizes several exceptions:

The parents are separated on a permanent or indefinite basis
The child does not reside with either parent
One parent has been absent for more than one month without the other parent knowing their whereabouts
One parent is incarcerated or institutionalized
One parent joins the grandparent’s petition
The child has been adopted by a stepparent

If a visitation order is granted and circumstances later change so that none of these qualifying conditions still apply, either parent may ask the court to terminate the order.

Grandparent Custody vs. Visitation in California

Visitation gives a grandparent scheduled time with a grandchild while the parents retain custody. Custody is a different matter entirely, and the legal standard is more demanding. To seek custody, a grandparent must generally show that placing the child with a parent would be detrimental to the child and that awarding custody to the grandparent serves the child’s best interests.

Custody petitions typically arise when a parent is incarcerated, struggling with serious substance abuse, or has abandoned the child. When the goal is to raise a grandchild on a permanent basis and the parents are largely out of the picture, a guardianship proceeding is often the more appropriate legal path. We handle guardianship matters separately from family court visitation petitions.

Filing a Grandparent Visitation Petition in Ventura County

If no existing family law case is open between the child’s parents, a grandparent files a new petition with the Superior Court of Ventura County, typically using Form FL-300 (Request for Order) and potentially Form FL-311 (Child Custody and Visitation (Parenting Time) Application Attachment). A family law declaration drafted by an attorney is the standard method for beginning that process.

If a divorce, separation, or parentage case is already active in family court, it may be possible to join that existing proceeding rather than open a new one. Either way, the grandparent’s petition must be properly served on the child’s parents, stepparents, and anyone with physical custody. Service requirements vary depending on how the matter is filed.

Mediation between grandparents and parents is often faster, less adversarial, and less costly than a contested hearing. Agreements reached through mediation can be submitted to the court for approval and become legally enforceable orders.
